Terms & Conditions
These Terms & Conditions (“Agreement”) govern your use of the SimpSocial platform, including but not limited to: www.simpsocial.com, app.simpsocial.com, the SimpSocial GoCRM suite, mobile and desktop applications, AI features (including Sarah AI), power dialer, messaging systems, and any related integrations (collectively, “Services”).
By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy.
If you do not agree to these terms, you may not use the Services.
Data Compliance & Consent
SimpSocial is committed to compliance with all applicable data privacy and consumer protection laws, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- Telemarketing Sales Rule (TSR)
- California Consumer Privacy Act (CCPA/CPRA)
- CAN-SPAM Act
- Children’s Online Privacy Protection Act (COPPA)
Clients must obtain and maintain express written consent before initiating any automated outreach through SimpSocial (voice, SMS, email, or AI-driven messaging). Consent records must be stored and made available upon request for audit or complaint review. AI communications through Sarah AI are trained to adhere to TCPA guidelines and must only be used with leads that have opted in.
Platform Usage & Compliance Obligations
You agree not to use the platform to:
- Send marketing messages without documented consent
- Engage in deceptive or unfair telemarketing practices
- Contact consumers listed on federal or state Do-Not-Call registries unless exempt
- Use SimpSocial to impersonate or spoof other businesses
- Circumvent privacy protections or spam filters via unauthorized means
You are solely responsible for ensuring that the content, timing, and recipients of all outreach comply with applicable laws and your own internal privacy and data use policies.
CRM & Third-Party Integrations
SimpSocial GoCRM may sync with third-party platforms (including CRMs, DMS systems, Meta Lead Ads, Google Ads, CarGurus, Cars.com, etc.). You authorize SimpSocial to:
- Send and receive data in real-time
- Tag, disposition, and route leads automatically
- Store customer data securely in the cloud
- Trigger automated responses based on configured workflows
You retain responsibility for the legality of the data you import or generate through these integrations.
AI Usage Disclosure
SimpSocial’s Sarah AI may simulate human conversation via SMS, email, and voice. AI-generated responses are transparently labeled in our records and can be reviewed upon request. Clients are expected to disclose automated communication to end-users in compliance with FTC guidance.
Data Privacy & Security
SimpSocial maintains industry-standard encryption and access controls. Data is hosted in secure environments with SOC 2, ISO 27001, or equivalent certifications. SimpSocial does not sell user or lead data.
Payment, Subscriptions & Termination
Payment obligations are outlined in your Master Service Agreement or subscription order. Early termination may result in fees as agreed upon in your onboarding documents.
Jurisdiction
This Agreement is governed by the laws of the State of New York (Nassau County). All disputes shall be resolved by binding arbitration in Los Angeles County, California, unless otherwise required by law.
